The Terrorist Finance Tracking Programme (TFTP) was set up by the U.S. Treasury Department shortly after the terrorist attacks of September 11, 2001 and has generated significant intelligence. The new agreement between the European Union and the United States of America on the processing and transfer of financial messaging data (TFTP Agreement) for the purpose of prevention, investigation, detection and prosecution of terrorism or terrorist financing, which took effect on the 1st of August 2010, is significantly improved in comparison to the interim agreement, especially in the field of respect of fundamental rights.
Specifically, the agreement enhances the protection of personal data by ensuring transparency of processing, as well as the rights of access, rectification and erasure of inaccurate data. In particular, Article 15 of the Agreement provides that the data subject is entitled to request access to his/her data that have been processed under the Agreement and Article 16 provides for the ability of the data subject to request the rectification, erasure or blocking of personal data that is inaccurate or processed in violation of the agreement. The aforementioned rights may be exercised before the U.S. Treasury Department through the national Data Protection Authority.
